On Friday, the Supreme Court chastised the Uttar Pradesh government for not following its directives and assigned the Muslim child, who was allegedly beaten up by his classmates at a school in the Muzaffarnagar district on August 25 at the instigation of their teacher, counsel from Tata Institute of Social Sciences (TISS), Mumbai.

In order to prevent any "strong orders," a bench of Justices Abhay S. Oka and Pankaj Mithal additionally instructed the state education department's principal secretary to virtually appear before them at the next hearing on December 11.

The court observed that the Uttar Pradesh government had disregarded directives issued on September 25 and November 7 directing the state to enable the child's enrollment into a private school and to provide appropriate counseling to him and his classmates.

We believe that the Uttar Pradesh government, and specifically the education department, has disregarded the many directives that this court has issued over the years. The victim child and the other kids engaged in the event are not receiving appropriate counseling. The state of Uttar Pradesh's strategy, based on the affidavits submitted, is, to put it mildly, "shocking." As a result, we designate the Tata Institute of Social Sciences (TISS), located in Mumbai, to provide counseling for the youngster as well as other kids. The youngster and other children will get counseling according to the form and manner suggested by TISS, according to Chief Justice Oka.

The great-grandson of Mahatma Gandhi, Tushar Gandhi, filed a PIL with the bench asking for punishment against those accountable for the occurrence.

The state's attorney Sanjay Jain's statement, which claimed the government had made the appropriate preparations for the victim child's admission to a private school, was also contested by the court.

Present the documentation proving the school's acceptance of the student. The court ordered the attorney to first provide a letter from the school, despite the attorney's attempts to argue that the child's father had not brought him to the school for enrollment.

"On September 25, the order was approved, and as of November 10, nothing has changed. The judges said, "In your state, pupils are treated this way, and the state says nothing.

If the court does not issue orders, the government will not act. The bench informed the state administration, "You have to make a stand on whether you will do something or just want face-saving measures."

"We hope and trust the secretary education department will personally look into the matter and ensure that the order passed by this court are complied in letter and spirit and affidavits are placed at least three days in advance before the next date," the court stated in its written order in an attempt to avoid taking harsh action.

It contested the state government's claim that the children were receiving counseling from an expert team made up of three physicians, a psychiatrist, a nurse, and a member of the community.

"These professionals, who are they? The bench questioned, "Do you think a nurse or secretary can do the counseling in such a serious incident?"

The attorney said that a psychiatrist had been added to the committee in response to the court's question about why a child psychologist had not been included.

"We expect the state to understand the difference between a psychiatrist and a child psychologist," the court said, rejecting the claim.
